Civil ou criminel : Quelles différences?

Il arrive qu’une situation donne lieu à la fois à un recours civil et à des accusations criminelles. Il arrive aussi qu’une situation soit à la frontière entre le droit civil et le droit criminel. Dans un tel cas, la police répond parfois: « Allez voir un avocat, c’est du civil! » et l’avocat renvoie à la police en disant qu’il faut « faire une plainte au criminel ».

 

Chicane de voisins, vol à l’étalage, harcèlement, fraude, les exemples sont nombreux et il peut être difficile de s’y retrouver.

 

Poursuite civile ou poursuite criminelle, le processus est différent, l’objectif est différent, les parties et les solutions possibles le sont tout autant.

Sometimes a situation arises in which a civil suit and criminal accusations are both possible. It can also happen that a situation is in a grey area between a civil and criminal matter. It’s in those kinds of situations that the police says « Go see a lawyer, it’s a civil matter! » and the lawyer sends you back to the police because you need to « make a criminal complaint »

Disputes between neighbors, shoplifting, harassment, fraud, there’s numerous examples and it can be difficult to find your way around.

 

Civil or Criminal cases, the process is different, the objective is different, as are the parties and solutions.
